Guidelines for Using AkkuFresh® Trademarks and Copyrights

AkkuFresh® trademarks and copyrights are valuable assets owned by Biokarma Ltd. These guidelines are designed for AkkuFresh® licensees, authorized resellers, developers, customers, and other parties who wish to use AkkuFresh®’s trademarks, service marks, or images in promotional, advertising, instructional, or reference materials, or on their websites, products, labels, or packaging. Unauthorized use of the AkkuFresh® Logo for commercial purposes without prior written consent from Biokarma Ltd. may constitute trademark infringement and unfair competition under federal and state laws. Use of AkkuFresh® trademarks is prohibited unless expressly authorized. If you are a licensee of an AkkuFresh® trademark or logo, please follow the special trademark usage guidelines provided in your license agreement. If no specific guidelines are provided, adhere to the rules outlined here. Additionally, AkkuFresh® Authorized Resellers or members of AkkuFresh® programs may be subject to additional restrictions. By using an AkkuFresh® trademark, you acknowledge that Biokarma Ltd. is the sole owner of the trademark. You also agree not to interfere with Biokarma Ltd.’s rights, including challenging its use, registration, or application to register the trademark. Furthermore, you must not harm, misuse, or bring into disrepute any AkkuFresh® trademark. The goodwill derived from using any part of an AkkuFresh® trademark belongs exclusively to Biokarma Ltd. Authorized Use of AkkuFresh® Trademarks

1. Advertising, Promotional, and Sales Materials

Only Biokarma Ltd. and its authorized resellers and licensees may use the AkkuFresh® Logo in advertising, promotional, and sales materials. Such use must comply with the terms specified in their agreement with Biokarma Ltd. and any associated guidelines. For example:

• Authorized Reseller
• Authorized Value Added Reseller
• Authorized Service Provider
• Authorized Wholesaler

2. Compatibility

Developers may use the AkkuFresh® word mark (but not the AkkuFresh® Logo or other Biokarma Ltd.-owned graphic symbols) in a referential phrase on packaging or promotional materials to indicate compatibility with AkkuFresh® products or technology. The following requirements apply:

1. The AkkuFresh® word mark must not be part of the product name.
2. Use phrases like “powered by,” “for use with,” “for,” or “compatible with.”
3. The AkkuFresh® word mark must appear less prominently than the product name.
4. The product must genuinely be compatible with the referenced AkkuFresh® product.
5. The reference must not imply endorsement, sponsorship, or false association with Biokarma Ltd.
6. The use must not portray Biokarma Ltd. or its products in a false or derogatory light.

3. Publications, Seminars, and Conferences

You may use an AkkuFresh® word mark in connection with book titles, magazines, periodicals, seminars, or conferences, provided you comply with the following:

1. The use must be referential and less prominent than the rest of the title. Example: XYZ CONFERENCE for AkkuFresh® Users.
2. The use must reflect favorably on Biokarma Ltd. and its products or technology.
3. Your name and logo must appear more prominently than the AkkuFresh® word mark.
4. The AkkuFresh® logo or other Biokarma Ltd.-owned graphics must not appear without express written permission.
5. Include a disclaimer: “(Title) is an independent (publication) and has not been authorized, sponsored, or otherwise approved by Biokarma Ltd.”
6. Include a trademark attribution notice in the credit section.

4. Websites

Websites serving as noncommercial electronic informational forums about AkkuFresh® products or ionXtra® Technology may use the AkkuFresh® word mark, provided they comply with the guidelines above.

5. AkkuFresh® Web Badge Licensing Program

Websites may use AkkuFresh® Web Badges if they use AkkuFresh®-branded hardware or software and comply with the AkkuFresh® Web Badges License Agreement. For more information, visit AkkuFresh® Web Badges.

Unauthorized Use of Biokarma Ltd. Trademarks

1. Company, Product, or Service Name

You may not use or register AkkuFresh®, AkkuFresh® Next Generation™, AkkuFresh® ECO™, ionXtra® Power Foil™, or any other Biokarma Ltd. trademark as part of a company name, trade name, product name, or service name unless expressly authorized.

2. AkkuFresh® Logo and Biokarma Ltd.-owned Graphic Symbols

The AkkuFresh® Logo and other Biokarma Ltd.-owned graphics may not be used without an express written trademark license.

3. Variations, Takeoffs, or Abbreviations

Variations, phonetic equivalents, or abbreviations of AkkuFresh® trademarks are prohibited. For example:

• Not acceptable: AkkuFreshness, AkkuFresh Cart, AkkuFreshMart

4. Disparaging Manner

You may not use Biokarma Ltd. trademarks in a disparaging manner.

5. Endorsement or Sponsorship

Do not use AkkuFresh® trademarks in a way that implies endorsement, sponsorship, or support by Biokarma Ltd.

6. Merchandise Items

You may not manufacture, sell, or give away merchandise items bearing AkkuFresh® trademarks without a written license.

7. AkkuFresh®’s Trade Dress

Do not imitate AkkuFresh® packaging, website design, logos, or typefaces.

8. Slogans and Taglines

Do not use or imitate AkkuFresh® slogans or taglines, such as “Do more…with us the fun never ends.”

9. Domain Names

Do not use AkkuFresh® trademarks in domain names. Examples of unacceptable domain names include:

• powerakkufresh.com
• akkufreshshop.com
• magakkufresh.com
• akkufreshmag.com

The ionXtra® Trademark

1. Standalone Use

The ionXtra® trademark may not be used alone except to refer to the Biokarma Ltd. ionXtra® product line.

2. Use in Product or Company Names

You may use “ionXtra®” in product or company names if:

1. “ionXtra®” is less prominent than the rest of the name.
2. The name does not suggest a false association with AkkuFresh® or Biokarma Ltd.
3. The name is not confusingly similar to any Biokarma Ltd. trademark.
4. You acknowledge Biokarma Ltd.’s ownership of the “ionXtra®” trademark.

Rules for Proper Use of Biokarma Ltd. Trademarks

1. Trademarks as Adjectives

Trademarks are adjectives and must modify a generic noun. For example:

• Correct: I bought two AkkuFresh® products.
• Not Correct: I bought two AkkuFreshness.

2. Generic Terms

Always include a generic term after the trademark, especially the first time it appears in a document.

3. Spelling and Capitalization

Always spell and capitalize trademarks exactly as shown in the AkkuFresh® Trademark List.

Proper Trademark Notice and Attribution

1. Distribution Within Hungary Only

Use the appropriate trademark symbol (™, SM, ®) the first time the AkkuFresh® trademark appears in materials distributed in Hungary. Include an attribution notice, such as:

• _________ and _______ are registered trademarks of Biokarma Ltd.
• _________ and _______ are trademarks of Biokarma Ltd.

2. Distribution Outside Hungary

Do not use trademark symbols on materials distributed outside Hungary. Use one of the following notices:

• _________ is a trademark of Biokarma Ltd., registered in the U.S. and other countries.
• _________ is a trademark of Biokarma Ltd.

Depictions of AkkuFresh® Products

1. Endorsement or Sponsorship

Biokarma Ltd. does not endorse the use of its logos, company names, product names, or images of AkkuFresh® products in third-party marketing materials.

2. Compatibility

Developers may show images of AkkuFresh® products in promotional materials to indicate compatibility, provided:

1. The product is genuinely compatible with the AkkuFresh® product.
2. The image is an actual photograph (not a rendering) and used with permission.
3. The depiction reflects favorably on AkkuFresh® and Biokarma Ltd.
4. The reference does not imply endorsement or sponsorship.
